Terms and Conditions

1. Introduction and Acceptance

The Study360 platform (referred to as “the Platform”) is an online service operated by Interactive Bulgaria Foundation (IBF), a non-profit organisation registered in Bulgaria under National ID 176889119 with its registered office at ul. "Nikolay Ostrovski" 5, Sofia, Bulgaria (telephone +359 877 366 209, e-mail ibfprojectbg@gmail.com). The Platform features an interactive map with panoramic images and panoramic videos and enables users to create educational lessons using those assets. The Platform is financed by the Erasmus+ project “S.P.Q.R. – Schools and People of Europe” (No. 2022-1-BG01-KA220-SCH-000086480). Access to the Platform is free of charge for all users.

By accessing or using the Platform, you agree to be bound by these Terms and Conditions ("Terms”). If you do not agree with any part of these Terms, you must not use the Platform.

2. Definitions

  • "User" – any natural person who accesses or uses the Platform.
  • "Account” – a personal registration on the Platform enabling a User to upload content, create lessons and interact with other Users.
  • "Content” – all materials available through the Platform, including text, data, panoramic images, panoramic videos, lesson files and any other content provided by IBF or Users.
  • "User-Generated Content” (“UGC”) – any panoramic images, videos or other materials uploaded by Users to the Platform.
  • "Public Content” – UGC designated by its uploader as public. Public Content can be accessed by other Users and may be used for creating lessons.
  • “Private Content” – UGC designated by its uploader as private. Private Content is visible to all Users on the map but may be used solely by the uploader to create lessons.

3. Account Registration

  1. Eligibility: Users must be at least 13 years old to create an Account. If you are between 13 and 17 years old, you confirm that you have consent from a parent or guardian.
  2. Methods of registration: You may create an Account using a Google account or by providing a username and password. You may also include optional information such as a profile picture, name, email address, “About me” section, Facebook link and LinkedIn link.
  3. Accuracy of information: You agree to provide true, accurate, current and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your username and password and for all activities under your Account.
  4. Security: You agree to use your own secure password and keep it confidential. The Platform reserves the right to disable any username or password if, in IBF's opinion, you have failed to comply with any of the provisions of these Terms. Similar educational platforms require users to keep their login credentials secure and prohibit unauthorised access.

4. Use of the Platform

  1. Educational purpose only: The Platform and all Content are provided solely for educational, non-commercial use. Users may view and create lessons from panoramic images and videos on the Platform; however, no Content (including UGC) may be downloaded or used for commercial activities. Other educational platforms similarly grant a limited, non-exclusive licence to use their content only for educational purposes.
  2. Free access: The Platform is free of charge for Users. Funding is provided through the Erasmus+ project, and no fees are charged for registration or use.
  3. No ownership transfer: The Platform grants you a licence to access the Content; it does not transfer ownership of any intellectual property rights. You may not reproduce, distribute, modify, or create derivative works from the Platform's software, design or Content without express permission. For example, similar services provide licensed content for educational use only and prohibit copying or creating derivative works.
  4. No download or extraction: All panoramic images and videos are hosted on the Platform. You may view these assets and use them to create lessons, but you may not download or extract them. The rights to such images and videos remain with their respective authors. IBF does not grant any rights beyond the ability to display the content through the Platform.
  5. Prohibited uses: You agree not to:
    • Upload, store, distribute or transmit any material that is unlawful, harmful, threatening, defamatory, obscene, harassing or racially or ethnically offensive, or that infringes another person's intellectual property rights.
    • Facilitate illegal activities or promote unlawful violence.
    • Attempt to gain unauthorised access to the Platform or other Users' accounts.
    • Introduce viruses or other malicious code.
    • Use the Platform for any commercial purpose or for the purpose of advertising, marketing or offering goods or services.
  6. Modifications: IBF may modify or discontinue any part of the Platform at any time, with or without notice, to maintain or improve the service.

5. User-Generated Content

  1. Ownership: Users retain ownership of their UGC. Similar agreements state that users maintain ownership of their content but grant a licence to the platform to use it.
  2. Licence to IBF: By uploading UGC, you grant IBF a non-exclusive, worldwide, royalty-free licence to store, display, reproduce and distribute your Content on the Platform for the purpose of providing and promoting educational lessons. You also grant other Users a licence to access and use your Public Content to create lessons. This licence continues until you remove your content from the Platform.
  3. Public and private settings: You may choose whether your panoramic images and videos will be Public Content or Private Content. If you choose public, you allow other Users to use the content for creating lessons. If you choose private, only you can use that content for lessons.
  4. Non-downloadable: Uploading your content does not grant any User (including IBF) the right to download it. Your content will exist only within the Platform and cannot be downloaded by others.
  5. Representations and warranties: By uploading UGC, you represent and warrant that:
    • You own or have obtained all rights and permissions necessary to upload the content and grant the licences described above.
    • You have obtained permission from any individuals identifiable in the content for their likeness to appear on the Platform.
    • Your content is not illegal, fraudulent, deceptive, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights or otherwise injurious.
    • The content does not contain viruses, spam or other harmful code.
  6. Quality and appropriateness: IBF reserves the right to review uploaded content. Any content that does not meet quality criteria or contains obscene or inappropriate material may be deleted without warning. Similar user-generated content agreements allow the platform to remove content that is illegal or violates its standards.
  7. Indemnity: You are solely responsible for your content. You agree to indemnify IBF against any claims, damages or expenses arising from your content, including claims that your content infringes the rights of others.

6. Intellectual Property

  1. IBF intellectual property: The Platform and its underlying software, design, logos, trademarks and other intellectual property are owned by IBF or its licensors. Except for the limited licence granted in these Terms, you obtain no rights in these intellectual property assets. Similar educational platforms state that all rights in the platform and licensed content remain with the platform operator.
  2. Third-party content: Some content on the Platform may be licensed from third parties. All rights in such content remain with the respective owners. You may not reproduce or distribute third-party content outside the Platform.

7. Privacy and Data Protection

IBF processes personal data in accordance with applicable data protection laws. Please refer to the Privacy Policy for information on how IBF collects, uses and protects personal data. By creating an account and using the Platform, you consent to the collection and use of your personal data as described in the Privacy Policy.

8. Disclaimers and Limitation of Liability

  1. Platform “as is”: The Platform and all Content are provided “as is” without warranties of any kind. IBF makes no representations or warranties regarding the availability, accuracy, completeness or reliability of the Platform or Content.
  2. No responsibility for UGC: IBF does not endorse or verify User-Generated Content. The Platform acts as a tool for sharing educational content, and IBF is not responsible for any errors, omissions, offensive material or other issues arising from UGC. Similar platforms include clauses stating that users have sole responsibility for the content they upload.
  3. Limitation of liability: To the fullest extent permitted by law, IBF shall not be liable for any direct, indirect, incidental, consequential or punitive damages arising from or related to your use of, or inability to use, the Platform or any Content. This includes any damages for loss of data, profits, goodwill or other intangible losses.
  4. No guarantee of uninterrupted service: IBF will use commercially reasonable efforts to keep the Platform available but does not guarantee uninterrupted access or that the Platform will be free from errors or viruses. IBF's responsibility is limited to the stability and existence of the Platform.

9. Termination

  1. Termination by user: You may terminate your Account at any time via the settings page. Upon termination, IBF may continue to retain certain data as required by law or to comply with these Terms.
  2. Termination by IBF: IBF may suspend or terminate your Account or remove any content at its sole discretion if you violate these Terms or if IBF believes that your use of the Platform could cause harm to the Platform or other users. Similar platforms reserve the right to suspend or terminate users in order to protect their service.
  3. Effect of termination: Upon termination, your right to use the Platform will immediately cease. Any licences granted by you to other Users under Section 5 will survive to the extent necessary to allow existing lessons created with your Public Content to continue to function.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the Bulgarian courts, unless otherwise required by applicable law.

11. Changes to the Terms

IBF may revise these Terms from time to time. Changes will be posted on the Platform with an updated “Last updated" date. If you continue to use the Platform after changes take effect, you agree to be bound by the revised Terms. You are advised to check these Terms periodically for any updates.

13. Acceptance of Terms

By creating an Account or using the Platform, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Platform.
